Johor State Assembly Not Professional in Answering Questions

The state assembly providea a platform for state assemblymen to debate government policies. State assemblymen can make use of this platform to debate issues related to public. In this process, It is essential for the government to provide official information with full transparency and with accurate official statistics. If the information is either not transparent, or the statistics is not clear, state assemblymen will not be able to debate / discuss certain issues effectively and accurately and thus the real problems faced by people cannot be reflected.

Opposition party and ruling party backbenchers can raise questions according to the problems faced by people in their constituencies during state assembly. Menteri Besar and Exco are obliged to answer accordingly in order to explain government policies to people and to answer people’s questions.

If the state government cannot answer the queries raised by the state assemblymen, it means that the state government is negligent / delinquent / not working properly and professionally. As a result, state assembly is losing its legislative function and is a waste of 

public funds.

I am very disappointed with the written reply provided by Johor state assembly during the last session of state assembly. The written reply provided by authority is not attaining the standard of assembly and very unprofessional.

Below are the examples of unprofessional replies :

 
1) The statistics given is ambiguous
I asked Johor state government or Federal government to provide the statistic of Malaysians working in Singapore. The authority stated that there are 150,000 to 300,000 Malaysians mainly working in manufacturing and servicing jobs in Singapore. 

Sadly, the estimated range of statistic given was too big. It raises large imagination as we cannot get the real picture from it. In the written reply, there was no clear government unit stated to indicate the source of statistic. In other words, the source of statistic was ambiguous too. 

I also questioned state government and federal government regarding how many Malaysians leave Malaysia through JB Custom and Second link respectively annually.

The statistic given was again unclear. I asked about the departure number of Malaysians at JB custom and second link, but the authority provided the lump sum clearance number of Malaysian passing through both the immigration.

Obviously, state government was not answering what I asked for. The statistic given were not representative at all and I doubt that the authority was trying to hide the statistic intentionally. 

The statistics given could not portray the real situation. People are confused with more question marks. 

2) Avoid direct reply

I also raised questions regarding the numbers of residential and commercial units sold by Country Garden since its launching until January 2015. 

Besides, I also asked state government to provide the gross income of JPO, Legoland and Hello Kitty theme park for financial year of 2012, 2013 and 2014. 

The written reply by the authority was : "relevant Exco will reply to me later".

The state government did not mention clearly that when the Exco will give me the answer. The time stated in written reply is “later”, which is without a specific deadline. This obviously showed that the state government was trying to avoid answering the questions. They tried to delay the time and did not give clear answer for my questions.

3) Use confidentiality as excuse and refuse to disclose

I also asked about annual salary of the Director Board members of Johor Corp and SAJ, but the state assembly / state government use confidentiality as an excuse to refuse to disclose.

I think they had violated the people’s right to know. While these two corporations are related to public interest, the board of director's annual salary should be made known to the public so that people can monitor whether the members of Director Board are well-performed.

4) Provide long irrelevant reply

I requested to know the legal custodian of one reserved land and explicitly required the authority to disclose the identity of the legal custodian.

However, the state government gave a long reply on the status quo of reserved land without disclosing who is the legal custodian. 

5) Use the limitation of administrative power as excuse to avoid disclosure of relevant information

Regarding Johor Causeway annual maintenance fee, the state assembly rejected to answer because it is under the federal government's administration.

However, the State Assembly Standing Order stated clearly that if the Speaker feels that the issue has great interest to Johorean, the Speaker may direct the state government to consult the federal government and answer to the issue in the state assembly.

Conclusion

State government gesture of not answering questions in any forms is intended to confuse the people, making it difficult for people to accept. If the state government continues to reply to state assemblyman in similar way, it will degrade the quality of state assembly. It is a waste of people’s money.

Do not answer questions raised by elected representatives, means or equivalent to not answering the questions concerned by the people. I believed the way the state government handled the questions raised by state assemblyman is very unprofessional. It is the “professional political trickery” played by ruling party.

In fact, people enjoy the right to know. People elected representatives to question state government in state assembly on behalf of them. The questions are related to the issues of public interest so that the people can understand the content and details of relevant issues through Q & A session of the state assembly.

The state government should give direct answer or accurate data so that the people and their elected representative will have a clearer picture. With the data, elected representatives can conduct better brainstorming and thus enhance the standard of assembly debate.

I urged the state government to take advantage of state assembly as a platform to respond to people’s questions about the government’s policies in order to clearly explain policies content, as well as the pros and cons of each social strata.

The state government should tell the people the positive and negative effect of policies factually and deliver relevant studies and data rather than playing "Tai Chi" by avoiding the questions of representatives to evade the responsibility as the state government, which is an incompetent, or even negligent performance.

I want state government to reply to my questions again. The state government had responded to my question unprofessionally. This situation cannot be continued, otherwise the state assembly will become an international laughing stock.

 


柔州議會書面答覆不专业及答非所問

士都蘭區州議員曾笳恩2月27日新聞稿




州立法議會的功能是提供議員們辯論國家政策的平台，議員們在此平台辯論與人民相關的課題。在辯論過程中，資訊的公開透明，官方數據的準確性，都是必須的，因此如果數據不明確，資訊不公開，議員們將無法準確地就課題進行辯論，更無法真實反映人民面對的問題。

在州議會，反對黨和執政黨後座議員都可根據其選區人民面對的問題提問，而州務大臣和州行政議員有義務在議會上，回答人民代議士提出的問題，藉此向人民解釋政府政策，回答人民的疑問。

若州政府無法回答議員們提出的詢問，是州政府失職的表現，同時也失去州立法議會的實際意義，沒有執行應有的議會功能，形同浪費人民公款。

我對柔佛州政府在上一季的州議會提問環節中，所提供的書面答覆感到非常失望，當局給予的答覆，根本不符合議會水準，此舉非常不專業。

以下針對我提出的書面提問，和柔州政府在上一季州議會上，給予的書面答覆，做系統整理，歸納出數項州政府在書面答覆環節上，犯下的不專業例子：

例子：
１）數據模稜兩可、不精準
我詢問柔州政府或聯邦政府，估計有多少馬來西亞公民在新加坡工作，得到的回覆是15萬至30萬人，主要從事製造業和服務業。但是，此數據想像空間大，同時也沒有確切數據顯示製造業和服務業的數據多寡。此外，答覆沒有明確說明數據來自政府哪個單位，數據來源模糊。

我也詢問州政府或聯邦政府，在2012年和2013年有多少馬來西亞公民經由新山關卡和第二通道出境(keluar daripada Malaysia)，答覆卻僅提供從2012年至2014年經由新山關卡和第二通道的通關人數(melalui)。

此數據模稜兩可，我是詢問離境人數，當局卻給我通關人數，至於離境和入境人數分別多少，則無法從提供的數據中查知，明顯答非所問，州政府並沒有提出我所要求的數據。我認為當局有意隱瞞數據，因為通關人數的數據並不具有代表性，無法讓人民了解真實情況，使人感到混淆，延伸更多問號。

州政府提供的數據無法使用，相關單位若要從事有關課題的研究，從而擬定政策，將無法有效執行。

２）推諉搪塞，避開正面答覆
我要求知道碧桂園開始發售單位後，至今年一月已成功售出多少住宅與商業單位，回覆指房屋及地方政府委員會主席將答覆。

我也要球州政府，提供JPO、Legoland和Hello Kitty主題樂園分別在2012年、2013年和2014年的總收入，回覆指旅遊、商貿及消費事務委員會主席將答覆。

但是，州議會卻沒有明確說明有關的行政議員將在何時回覆，顯然迴避問題，推諉搪塞，拖延時間，沒有針對我的提問做出答覆。

３）以秘密為由，不肯透露相關資訊
對於柔佛州控股及柔佛州水務局的董事會年薪，議長辦公室回函援引議會常規第25(2)(h)條文，指這涉及機密，拒絕回應。

我認為州政府此舉已侵犯人民的知情權，因為這兩個機構和公眾利益有關，機構董事會的年薪應公開透明，人民有權利知道，從而檢視董事的表現是否達標。

４）以長篇大論的方式，答非所问
我針對某保留地的合法管理人做出提問，並相當明確地要求政府透露合法管理人的身分。政府卻對此土地的現狀長篇大論，就是不肯透露誰是合法管理人。

５）以非職權管轄範圍為由，迴避透露相關資訊
我詢及新柔長堤每年的維修費時，州議會選擇拒絕回答，原因是此項目是由聯邦政府管轄。

可是，議會常規第25(6)條文清楚說明，如果議長認為有關課題對柔州人民有密切的利益關係，議長可以指令州政府諮詢聯邦政府，並在州議會回答有關課題。

結論
州政府任何形式的迴避，答非所問，是有意混淆人民，敷衍了事，此舉難以讓人民接受。若類似的回應方式再繼續下去，將拖垮議會素質，浪費公款。

同時，不回答代議士所提出的問題，就等同於不回答人民所關心的問題。我認為，州政府對議員提問的處理方式，所展現的不專業，是執政黨的「專業政治權術」。

其實，人民享有知情權，人民代議士代表人民向州政府在州議會上，提問涉及公眾利益的問題，讓人民了解相關課題的內容和細節。

州政府若持續下去，州議會將無法維持素質，失去應有的議會水準，使議會淪為橡皮圖章。

州政府給予正面回答或正確數據，將讓人民及代議士們更清楚狀況，大家更能集思廣益，間接提升議會辯論的水平。

我呼籲，州政府應利用州議會作為平台，來回應人民對政府施政的疑問，向人民清楚解釋施政內容，以及利惠人民的各種利弊，就事論事地提出政策對人民正面和負面的影響，甚至是相關的研究報告和數據，而不是耍太極，通過迴避議員們的問題，來逃避作為州政府的責任，這是一種不稱職，甚至是失職的表現。

我要求他們重新回覆我提出的問題。州議會之前已以這種方式回覆議員問題，上一季仍如此，此舉不能再繼續下去，否則州議會將如兒戲，成為国际笑柄。

「集百家米, 聚百家福」百家米新春活動 Kumpul Beras, Edar Bahagia

（新山14日訊）「集百家米，聚百家福！」，由士都蘭區州議員辦公室舉辦的百家米新春活動，今早於新山聖淘沙廣場舉辦，約300人齊聚一堂，參與施米納福、摻米聚福、派米積福，將愛心散播社區，也把滿滿的福份帶回家！

活動當天吸引約300名附近的居民，扶老攜幼前來，共同體驗摻米樂，更有一群小孩圍坐在米缸旁，從摻米的過程中體會百家米的意義，在玩樂的同時領悟施米和派米是一種傳播愛心的行為。

現場除了華族參與活動，也吸引友族父母攜帶子女一同摻米，將百家米包進小米袋後，把社區祝福帶回家，可見百家米活動不僅限於單一族群的參與。

主辦單位在1月23日展開百家米新春系列活動，至今已收集超過百戶家庭的愛心米，整個系列活動參與人數達500人，為社區注入活力。

活動當天出席者包括行動黨國會領袖林吉祥、柔佛再也區州議員廖彩彤和行動黨柔州州委黃祥鸞。

士都蘭區州議員曾笳恩致詞時表示，當天舉辦的百家米活動，除了讓民眾了解百家米的意義，更希望通過這項活動，鼓勵民眾自發參與親子活動，推廣家庭價值觀，提升家庭凝聚力，讓民眾在繁忙的工作之餘，也重視與孩子之間的關係，在周末休假時，儘量爭取與孩子相處的時間。

他表示，其實，仔細觀察，本地社區活動較少，和親子相關的活動更少，以澳洲為例，大城市如悉尼、布里斯本等，當地市政府經常通過相關部門，長期性舉辦可讓全體市民共同參與的社區活動，尤其是親子活動。

「例如，鼓勵父母攜帶子女到市中心廣場或公共活動空間，參與歌唱、跳舞、吟詩等寓教於樂的輕鬆活動，讓孩子除了在活動中學習，也能促進親子關係，讓家庭更和諧。」

然而，他指出，本地少見此類社區活動，而且多由民間團體或非政府組織舉辦。

「其實，地方政府應採取主導角色，經常性舉辦親子活動，增加活動的草根性，讓全民皆可參與，不論來自哪個種族、宗教和文化，都能藉由輕鬆的親子活動，互相了解彼此，提倡家庭價值觀。」

同時，他認為，地方政府應給予地方議員更多空間，協助舉辦有意義的社區活動，不以任何政治因素為考量，不分黨派，讓全民都能參與社區活動。

百家米新春活動記者發布會新聞稿

（新山日23日訊）「集百家米, 聚百家福！」，收集百家米是中國民間傳統習俗，寄寓了對家人的關愛和祝福，為了提倡家庭價值觀，把愛心注入社區，士都蘭區州議員辦事處將於2月14日舉辦「百家米系列活動」，收集和傳播眾人祝福。

百家米是中國民間傳統習俗，所謂「一碗百家米，終身不發愁，入肚安五臟，百年病全丟」，這是民間對百家米的一種說法。

中國早期屬農耕社會，稻米谷糧是農村主要糧食。收集百家米源自中國民間傳統習俗，廣泛流傳於廣東梅縣、廣西柳城、壯族、江西、蒼南民間和湖北農村等中國各地，寄寓了長輩對小孩健康成長的願望，以及子女冀望父母身體無恙的心願。

一般上，祈福者到各家收集百家米後，將各家米摻在一起煮熟食用，吃了匯集百家米煮成的飯，意即接收百家的祝福，期望來年順利，家庭和諧，消災解難，小孩和老人平安健康。這是一項通過誠心求取百家米糧，集聚百家祝福，讓關愛的家人得到幸福的溫馨小舉動。

「百家米系列活動」將在1月23日正式開跑，分為三階段進行。首階段為「施米納福」，主辦單位呼籲大眾施贈白米，匯集福氣，本辦事處是百家米活動收集中心，有興趣居民可到辦事處施米，份量隨喜。

次階段為「摻米聚福」，活動將在2月14日舉辦「摻米儀式」，將匯集了百家的米糧混雜在一起，邀請民眾攜家帶眷，到新山聖淘沙廣場參與摻米活動，將眾人的愛心米包入小米袋，共同包裹一包包的百家米，不只接收百家祝福，也獻上每人小小的福氣和愛心。

第三階段為「派米積福」，有興趣民眾可參與派米活動，把分批包好的小米袋派送至每戶人家，將愛心注入社區。民眾也可在摻米活動當天，直接將包好的小米袋帶走，把好福氣帶回家，為一家人祈福祝願。

「摻米儀式」的活動當天（2月14日），主辦單位也將準備充滿新年喜氣的「百家米」活動布景，邀請前來加入摻米活動的家庭，照一張全家福帶回家，將這份有意義的記憶以照片記錄下來，同時也通過這場社區家庭活動，提倡家庭和諧的優良價值觀。

Johor Bahru - Stulang State Assemblyman Chen Kah Eng urged the government to pay attention to the high rate of divorce cases in Malaysia. He stated that religious groups and NGOs should be encouraged by the government to organize premarital counseling programs.

Meanwhile, Chen Kah Eng hoped the government encourages all sectors of society and all ethnic groups to attend premarital counseling sessions before marriage. 

He pointed out that according to statistical data in 2014, there are more than 20% divorce rate in Malaysia, the highest divorce rate in Southeast Asia, of which about 70% of the ex-husband escape to pay for alimony.

“This statistical data reflects the serious divorced situation in Malaysia.” He said.

He mentioned, “ The government could encourage religious groups to conduct premarital counseling programs, so that the newly married couples could first understand the challenges faced in daily life after marriage before entering a new marriage relationship and encourage couples to go through their after-marriage life together.”

In addition, he stated that some NGOs can provide premarital counseling courses and advocate the importance of these programs to the public in order to avoid conflicts due to old habits and trivial matters which could deteriorate the harmonious relationship between husband and wife. 

“Ministry of women, family and community development should address the circumstances of the divorce rate increased year by year, to develop strategies to reduce the divorce rate.” He added.

On the other hand,ChenKahEng also stressed that besides premarital counseling courses, marriage counseling is equally important.

“ Premarital counseling is for newlyweds having mental preparation before entering a marriage while marriage counseling is more for practical rather than theoretical issues. Marriage counseling will generate greater help in community.”

He pointed out that the main reason for Malaysians divorce including early marriage, domestic violence and having an affair. According to police data, the number of domestic violence cases from 2000 to 2012 is 42449, Selangor is the highest states in domestic violence cases, followed by Perak, Penang Sabah and Johor, of which over 90% of domestic violence victims are women.

Besides the problem of domestic violence, high divorce rate will increase the number of single mothers as well. Chen Kah Eng mentioned, in 2013, Johor registered single mothers are 5422 while there are a lot of single mothers did not come out to register because of education and awareness. 

“I believe the real number of single mothers are far more higher than the registered number.” He added.

Therefore, Chen Kah Eng believed, only by strengthening premarital and marriage counseling, can help to reduce this type of social problems arising from marital problems. 

“Government plays an important role in encouraging NGOs and religious groups to make a contribution by participating in the organization of premarital and marriage counseling.” He said.

士都蘭區州議員曾笳恩2月13日新聞文告

（新山13日訊）士都蘭區州議員曾笳恩呼籲，政府須重視離婚率高的問題，鼓勵宗教團體和非政府組織，舉辦婚前輔導課程。

同時，曾笳恩希望，政府鼓勵社會各階層和各族在結婚前，都必須上婚前輔導課程。

他指出，據2014年數據，馬來西亞離婚率超過20%，列東南亞之冠，其中約70%的前夫逃避交付贍養費，此數據反映馬來西亞離婚情況嚴重。

「政府可鼓勵各宗教團體進行婚前輔導，讓新婚夫妻在進入一段新的婚姻關係之前，先了解結婚後將可能面對的情況，鼓勵夫妻攜手度過生活難題。」

此外，他提到，一些民間非政府組織也可提供婚前輔導課程，向民眾倡導接受婚前輔導課程的重要性，避免婚後夫妻因生活瑣事衝突，影響夫妻和諧關係。

「婦女、家庭及社會發展部應正視離婚率逐年上升的情況, 擬定策略降低離婚率。」

另一方面，曾笳恩也強調，除了婚前輔導課程，婚後輔導也同樣重要。

「婚前輔導是新婚夫婦準備進入婚姻前的心理預備，婚後輔導則多為實際問題而非理論，鼓勵婚後輔導將對社會有更大幫助。」

他指出，馬來西亞人離婚的主要原因包括早婚、家暴和外遇，其中根據警方數據，從2000年至2012年的家暴數量有4萬2449宗，雪州是家暴案件最高的州屬，其次為霹靂、檳城、沙巴和柔佛，當中超過90%的家暴受害者都是女性。

除了家暴問題，離婚率高漲還會使單親媽媽人數上升，曾笳恩提到，在2013年，註冊的柔州單親媽媽就有5422人，有不少單親媽媽因為教育和意識問題，沒有出來登記，相信有關數據更多。

因此，曾笳恩認為，唯有加強婚前和婚後輔導，可協助降低這類因婚姻問題而衍生的社會問題，而政府在當中扮演重要的角色，鼓勵非政府組織和宗教團體盡一份力量，參與婚前和婚後輔導課程的舉辦。

Strongly urge to cut the electricity and water tariff charged by TNB and SAJ and to cancel EDL toll

Johor Bahru - Stulang State Assemblyman Chen Kah Eng strongly urged Malaysian government should first set a good example to cut the electricity and water tariff charged by TNB and SAJ, canceled the toll fees of EDL and Johor Bahru custom, in order to reduce the economic burden of people.

As Prime Minister urged the people to be bright consumers and do not patronize businesses with unreasonable pricing, Chen Kah Eng pointed out that electricity and water tariff charged by TNB and SAJ, and also the toll fees of EDL are far more unreasonable with high pricing, but there is no choice for the people to reject purchasing.

“ The electricity and water tariff set by TNB and SAJ are unreasonable. It is expensive for people and businesses. However, do the people have the right to choose not to patronize these companies?”

He mentioned that TNB had increased electricity tariff in 2011 and 2014 for 7% and 15% respectively, ending up with 22% increasing rate within 4 years. This causes domestic businesses forced to raise prices due to high cost. 

“However, cost of TNB decreases accordingly due to global oil prices drop drastically recently, TNB does not cut down electricity tariff to benefit the people. Instead of it, Prime Minister called upon businesses to reduce prices actively while this appeal does not make sense.”

He stated that there is only one corporate supplying electricity and water to people respectively. People have no other choice except patronizing from monopolized companies for daily usage. 

“It is ridiculous that the Prime Minister does not urge those monopolized companies to reduce prices for the well-being of people.”

He further mentioned that the toll fees of EDL is also unreasonable and people are forced to pay for high pricing.

“It is kind of forcing people to have high consumption by government. Can people reject to patronize electricity from TNB? Can people not to use the water supplied by SAJ? Can people choose not to pay for toll fees of EDL?”

He emphasized that TNB gained much profit from increment of electricity tariff in recent years. It should fulfill corporate social responsibility by rewarding its profit to society.

“There is no electricity supply in some rural places, TNB should help to install electricity infrastructure to fulfill social responsibility but not aim at earning profit.”

曾笳恩強烈要求國能和水務局先降價，並取消東疏大道收費及關卡收費站

（新山4日訊）針對首相納吉呼籲國內商家主動降價，士都蘭區州議員曾笳恩表示，政府首先應以身作則，強烈要求國能和水務局先降價，並取消東疏大道收費及關卡收費站，減低人民的經濟負擔！

他指出，首相促消費者精明消費，勿光顧不合理訂價的商家，但國能、水務局和東疏大道收費也不合理，價格昂貴，但是人們是否有權利選擇不光顧這些不合理訂價的企業？

「國能近年曾兩度調漲電費，去年馬來半島電費平均上漲15%，2011年中則平均調漲7%，兩次調漲達22%，牽一髮動全身，商家成本也隨著增加，如今世界原油價格下跌，國能成本減低，但電費卻不降價，首相反而呼籲商家主動降價，純屬本末倒置。」

曾笳恩今日發出文告，針對首相日前的發言，指「國內油價下調至10年來新低，呼籲商家配合主動降價，促消費者勿光顧不合理訂價商家」，發表看法。

曾笳恩提到，國內只有一家企業提供人民電源和水源，人民沒有任何選擇，只能向唯一一家企業「購買」每日所需水電，但是價格昂貴不合理，首相卻沒有呼籲該企業降價，為人民謀福利。

他也說，政府向人民徵收東疏大道過路費，也屬於不合理收費，且人民沒有選擇權。

「這有如政府逼人民吃貴貨。試問，人民可以不光顧國能嗎？可以不光顧水務局嗎？可以選擇不繳付東疏大道過路費嗎？」

他以國能為例，國能分別在2011年和2014年以油價上漲為由，調漲電費，利潤逐年增加，加上只有一間企業負責提供電源，屬壟斷性價格，如今成本降低，國能應將利潤回饋予社會，盡到企業的社會責任。

「國內一些地方仍沒有電力供應，國能除了降價，還應協助這些偏遠地區安裝電力設備，不應因為該區沒有利潤而不安裝。」
